Welcome to the RedCap platform, including RedCap Task, RedCap Coupon, and RedCap Ticket. These platforms are exclusively owned and operated by EASYCLOUDTECH INC (“Company,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of RedCap Task (“User Platform”), RedCap Coupon (“Coupon Platform”), RedCap Ticket (“Ticket Platform”), and RedCap Tasker (“Merchant Platform”). By accessing or using any of these platforms, you agree to be bound by these Terms.

1. Introduction

RedCap is a comprehensive service platform that includes RedCap Task (appointment services), RedCap Coupon (local merchant group buying discounts), and RedCap Ticket (event ticket sales). RedCap Tasker is the platform for merchants to publish and manage services, discounts, and event tickets. This Agreement applies to all users of RedCap Task, RedCap Coupon, and RedCap Ticket, as well as merchants, outlining their respective rights and obligations.

 

2. Scope and Definitions

•“User”: Any individual or entity accessing or using RedCap Task, RedCap Coupon, or RedCap Ticket.

•“Tasker”: Service providers registered on RedCap Tasker to offer services.

•“RedCoin”: The designated virtual currency for transactions within the platforms.

•“Content”: All digital materials, including text, images, videos, and audio, available on the platforms.

 

3. License Grant and Restrictions

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable license to access and use RedCap Task, RedCap Coupon, RedCap Ticket, and RedCap Tasker for legitimate purposes. You agree not to:

•Use the platforms for any unlawful activities or in violation of applicable laws.

•Abuse the platforms in any manner that may damage, disable, overburden, or impair our services.

•Reproduce, modify, distribute, or create derivative works from any part of the platforms without prior written permission from the Company.

 

4. User and Tasker Obligations

•Compliance with Laws: Users and Taskers must comply with all applicable laws, rules, and regulations, including data privacy, consumer rights, and local business requirements.

•Prohibited Activities: The platforms shall not be used to distribute harmful or malicious software, engage in fraudulent activities, or misrepresent identity.

•Transparency: Taskers must accurately represent their qualifications and services, while users must provide complete and accurate information when booking services.

5. Intellectual Property Rights

The Company retains all rights, title, and interest in and to RedCap Task, RedCap Coupon, RedCap Ticket, and RedCap Tasker, including all related intellectual property rights. Unauthorized use, reproduction, or modification of any part of the platforms is strictly prohibited and may result in legal action.

 

6. Content Responsibility and Data Use

•User Content: Any content submitted by users or Taskers, including reviews, feedback, or other user-generated content, is the responsibility of the individual who posted it. By providing content, you grant the Company a royalty-free, perpetual license to use such content for platform operations, marketing, and analytics.

•Data Protection: RedCap Coupon encrypts user and merchant data to ensure privacy and security. The Company reserves the right to use anonymized data for marketing, research, and service improvements in compliance with applicable data protection laws such as GDPR and CCPA.

7. Tasker Representations and Responsibilities

Taskers on RedCap Tasker affirm that they:

•Comply with all relevant qualifications and certifications required for their services.

•Adhere to all local, state, and federal regulations applicable to their service offerings.

•Follow the Company’s policies, including those related to pricing, service standards, and customer satisfaction.

8. Account Security

You are solely responsible for maintaining the confidentiality of your account information, including your password. You agree to notify the Company immediately of any unauthorized use of your account. The Company is not liable for any loss that you may incur as a result of someone else using your account with or without your knowledge.

9. Disclaimers

The Company provides RedCap Task, RedCap Coupon, RedCap Ticket, and RedCap Tasker on an “as is” and “as available” basis. We disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not guarantee that the platforms will be uninterrupted, error-free, or secure.

10. Limitation of Liability

The Company is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruptions, arising out of or related to your use or inability to use the platforms. Our liability is limited to the amount you have paid for services through RedCap Task, RedCap Coupon, or RedCap Ticket in the six months prior to the incident giving rise to the claim.

11. Fees, RedCoin Transactions, and Refunds

•Tasker Fees: Taskers agree to pay service fees for using RedCap Tasker, which are denominated in RedCoin, in accordance with the platform’s pricing policies.

•Refund Policy: RedCoin transactions are generally non-refundable unless otherwise required by law or in cases of platform error. Users must adhere to each Tasker’s refund policies when booking services.

•RedCoin Expiration: Unused RedCoins may expire after a specified period of inactivity, and users have no right to exchange RedCoins for cash.

 

12. Dispute Resolution

•Internal Resolution: Users and Taskers are encouraged to resolve disputes through direct communication. If this is unsuccessful, either party may request mediation by the Company.

•Arbitration: Unresolved disputes will be subject to binding arbitration under the rules of the American Arbitration Association. The losing party shall bear the costs of arbitration unless otherwise determined by the arbitrator.

•Malicious Dispute Claims: Users who initiate disputes in violation of Tasker refund policies will be liable for all related costs. The Company reserves the right to charge users through their saved payment methods in cases of malicious disputes.

13. Amendments to Terms

The Company reserves the right to amend these Terms at any time. Changes will be communicated through platform announcements or email. Continued use of RedCap Task, RedCap Coupon, and RedCap Ticket constitutes acceptance of the amended Terms. Users have 30 days to accept the changes or discontinue use.

14. Third-Party Links and Content

The platforms may include links to third-party websites or resources for user convenience. The Company does not endorse and is not responsible for the content or services of such third-party sites. Users access these links at their own risk.

 

15. Termination of Services

The Company reserves the right to terminate or restrict access to RedCap Task, RedCap Coupon, and RedCap Ticket at its discretion, without prior notice, including but not limited to violations of these Terms or any applicable policy. Upon termination, all licenses granted under these Terms will cease immediately.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States and the state in which the Company is located. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in the applicable jurisdiction.

17. General Provisions

•Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the use of RedCap Task, RedCap Coupon, and RedCap Ticket.

•Severability: If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.

•Waiver: The Company’s failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

19. Online Booking Waiver and User Agreement

By booking any outdoor activities or training services through this platform, the User acknowledges and agrees to the following terms:

1.Risk Acknowledgment: Users acknowledge the inherent risks of outdoor activities and personal training, including potential injuries, disabilities, or death, and voluntarily assume these risks.

2.Health Declaration: Users declare they are in suitable health to participate and have disclosed any relevant health conditions to the service provider.

3.Waiver and Release of Liability: Users agree to release the platform and its partners from any claims or damages arising from participation in activities, to the fullest extent permitted by law.

4.Emergency Treatment Consent: Users authorize service providers to take necessary medical action in emergencies and agree to bear all related costs.

5.Image Rights: Users grant the service provider the right to use their likeness in promotional materials without additional compensation.

20. Notification of Unpaid Balance

•Balance Notification: Users will be notified of any unpaid balance and will have 48 hours to settle the amount due.

•Payment Methods: Payments can be made through the RedCap Task mobile app using credit cards, Apple Pay, or other available options.

•Collection Process: If payment is not received within 48 hours, the Company reserves the right to charge the outstanding amount to the user’s saved payment method. Unresolved balances may be sent to a collection agency.

21. Accessibility Policy

Terms of Service

Welcome to the RedCap family of services, which includes RedCap Task, RedCap Coupon, and RedCap Ticket (collectively referred to as the "Platform"), along with the merchant interface, RedCap Tasker. Please read these Terms of Service ("Terms") carefully before using the Platform. By registering as a user or using any part of this Platform, you agree to comply with these Terms. If you do not agree to these Terms, please do not use the Platform.

 

1. Platform Services

The Platform provides an online marketplace connecting users seeking services with service providers (referred to as "Taskers"). RedCap Task facilitates bookings for services, RedCap Coupon offers local merchant group-buying discounts, and RedCap Ticket focuses on event ticketing. The Platform acts solely as an intermediary and does not directly participate in transactions or provide services.

 

2. Age Requirement

Users must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the capacity to enter into a binding contract.

 

3. User Accounts

To use the Platform, you must register a user account. You agree to provide accurate, complete, and up-to-date information and to update your account promptly if any changes occur. You are responsible for maintaining the confidentiality of your account information and password, as well as all activities that occur under your account.

 

4. User Conduct

As a user, you agree to comply with all applicable laws and regulations and not engage in any unlawful, fraudulent, or abusive behavior while using the Platform. You shall not transmit viruses, malware, or any other content that may damage or harm the Platform. We reserve the right to remove inappropriate content and suspend or terminate user accounts at any time.

 

5. Service Provider Responsibilities

Service providers ("Taskers") must adhere to all Platform rules and regulations and ensure that they possess the necessary skills, qualifications, and licenses to perform their services. The Platform reserves the right to verify the qualifications of Taskers and review service quality at any time.

 

6. Payments and Refunds

All payments made through the Platform are processed by our designated third-party payment processor. Refunds will be handled in accordance with the Tasker's refund policy. For further details regarding refunds and damage compensation, please refer to the Platform's relevant pages.

 

7. Service Quality and Dispute Resolution

The Platform makes no express or implied warranties regarding the quality of services provided by Taskers. In case of disputes, users and Taskers should first attempt to resolve the matter amicably. If resolution cannot be reached, users and Taskers may request mediation from the Platform. Where necessary, users and Taskers retain the right to seek legal remedies.

 

The Platform serves only as an intermediary connecting users with third-party service providers. Regarding third-party service providers, the Platform is not liable for:

- The quality, reliability, or satisfaction of services provided by third-party service providers;

- The accuracy, completeness, or reliability of service providers’ qualifications, experience, and reviews;

- Contractual relationships, contract performance, and dispute resolution between users and service providers;

- Any loss, damage, or liability resulting from the actions of third-party service providers (including but not limited to negligence, breach of contract, or tortious acts).

 

We strongly recommend that users carefully review the qualifications, experience, and reviews of service providers before hiring them. If necessary, ensure that contract terms are clear and comprehensive when entering into agreements with service providers to protect the rights and interests of both parties.

 

8. Intellectual Property

The Platform and its content, features, and design (including but not limited to icons, logos, text, images, audio, video, software, and other materials) are the property of us and/or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, distribute, transmit, sell, license, modify, translate, create derivative works, or otherwise use any part of the Platform without our express written permission.

 

9. Disclaimer

The Platform and all its content, features, and services are provided on an "as is" and "as available" basis, without any express or implied warranties. To the fullest extent permitted by applicable law, we make no warranties as to the accuracy, completeness, reliability, availability, security, or error-free nature of the Platform and its content, features, and services.

 

10. Limitation of Liability

In no event shall we or our affiliates, directors, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the use of or inability to use the Platform and its content, features, and services, even if we have been advised of the possibility of such damages.

12. Data Security Measures

These Terms and their interpretation, enforcement, and dispute resolution shall be governed by the laws of the United States. You agree that any disputes arising out of or relating to these Terms will be subject to the jurisdiction of the state or federal courts in the applicable state.

 

17. Pet Care Services Liability

The Platform does not assume responsibility for potential losses arising from pet care services or other services involving living entities. While the Platform may assist users in conducting background checks on service providers, we cannot guarantee the accuracy of the information provided.

 

18. Marketing and Promotion

- Authorization: By uploading images, text, descriptions, pricing, and other content to the Platform, merchants grant us a perpetual, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display the content for marketing, promotional, and media purposes across various channels, including social media, company websites, and third-party marketing campaigns.

- Scope of Use: The content may be used in whole or part for promoting the Platform and the services offered by the merchants. This includes advertisements, banners, promotional campaigns, and other marketing materials.

 

19. Termination Rights

We reserve the right to terminate or restrict access to RedCap Task, RedCap Coupon, and RedCap Ticket at our discretion without prior notice.

Refund and Property Damage Protection

Attention: This clause applies only to orders booked and paid (online or offline) through the platform software. If service personnel or users privately arrange and complete transactions outside the platform, neither the platform nor the company will handle any related policy, and will not assume any legal responsibility for any circumstances that occur.

 

We highly value your satisfaction and are committed to providing you with high-quality, reliable services. To ensure your interests are protected, this guarantee aims to provide you with a greater sense of security and confidence when using our platform.

Satisfaction Guarantee policy:

  1. Service Quality: All service providers on our platform are required to go through strict review and certification processes. We continuously monitor the quality of their services and ensure they adhere to our industry standards and service guidelines. If you are unsatisfied with the service provider's quality, please contact our customer support team within 7 days of service completion. We will investigate and take appropriate measures to resolve your issue. No appeals will be processed by the platform after 7 days from the end of the service.

  2. Refund Policy: If, after investigation, we determine that the service provider failed to fulfill their service commitment or you have reasonable complaints about the services provided, we will offer you a refund based on the specific situation. The refund amount will be determined based on the service provider's performance and the severity of the issue. Please contact our customer support team within 7 days of service completion. We will conduct an investigation and take appropriate measures to resolve your issue. The platform will not handle any appeals after 18 days from the end of the service.

  3. Service Provider Replacement: If you are dissatisfied with the service provider, you can request to cancel the order on our platform and select a new service provider. Please note that you must adhere to the service provider's refund policy, and any forfeited deposits will be subject to negotiation between the third party and the user for a refund.

  4. Customer Support: Our customer support team is always available to help you. If you have any questions or concerns, please feel free to contact us. You can reach us via phone, email, or online chat. We will respond to your inquiries as soon as possible and strive to provide you with solutions.

Property Damage Guarantee policy:

  1. Insurance Coverage: We require all service providers on our platform to have valid and legal insurance (not guaranteed for every service provider). This includes insurance for property damage. If you encounter any property damage during the service, please contact our customer support team immediately.

  2. Claim Process: In the event of property damage, please contact our customer support team within 48 hours of the incident via phone, email, or online chat. Provide a detailed description of the damage and relevant evidence (such as photos, videos, etc.). We will promptly process your claim request and coordinate with the service provider's insurance company. No appeals will be processed by the platform after 7 days from the end of the service.

  3. Compensation Amount: Based on the specific situation and the insurance company's assessment, we will strive to ensure you receive reasonable compensation. Please note that the compensation amount may be subject to the insurance company's terms and conditions.

  4. Customer Support: Our customer support team is always available to help you. If you have any questions or concerns, please feel free to contact us. We will respond to your inquiries as soon as possible and strive to provide you with solutions.

  5. Special Event Complaints: Please contact customer service within 7 days. When the platform customer service intervenes in special events for mediation between both parties, after a thorough investigation, if the service provider is confirmed to be at fault but is unable to fulfill compensation obligations, the platform may provide appropriate compensation to the user within the legal scope (up to $1,000). The platform reserves the right to decide the compensation price and retain the right to initiate legal action, insurance claims, or collections litigation against both parties. No appeals will be processed by the platform after 7 days from the end of the service.

Disclaimer: Pet Boarding, Grooming Services and more

Risk Disclosure for Live Services: The pet boarding and grooming services provided through our platform may carry unforeseeable risks. While we require service providers to adhere to the highest professional standards and diligent operating procedures, it's important for pet owners to understand that unpredictable and irreversible incidents can occur during the provision of live services.

Liability Disclaimer: In the event of any irreversible or unforeseeable accidents occurring during the provision of live services such as pet boarding and grooming, our platform and company shall bear no legal responsibility. We advise pet owners to carefully consider potential risks before opting for such services and consult professional advice if necessary.

Service Provider Responsibility: Note that service providers may assume responsibility in accordance with their independent service agreements, insurance terms, and operational policies. Pet owners should communicate directly with service providers to understand their terms of service and scope of responsibility.

Risk Mitigation Measures: We encourage both pet owners and service providers to jointly take appropriate precautionary measures to minimize any potential risks.

Ticket Terms

RedCap Ticket Purchase Agreement

Effective Date: December 2, 2022

 

1. Introduction

Welcome to the RedCap Ticket service, provided by EASYCLOUDTECH INC (“the Company”). Through RedCap Ticket, users (“Users”) can purchase tickets, and event organizers (“Event Organizers”) can create, promote, and sell tickets for events. These Terms of Service (“Terms”) apply to all users of the RedCap Ticket platform and incorporate the Company’s Privacy Policy and other referenced policies.

 

2. Acceptance of Terms

By accessing or using RedCap Ticket, you agree to comply with these Terms(include Terms of Use, Privacy Policy). Your continued use of the service signifies that you have read, understood, and accepted these Terms, the Privacy Policy, and any other applicable policies.

 

3. Roles of Users and Event Organizers

- User: An individual or entity purchasing tickets or attending events through the RedCap Ticket platform.

- Event Organizer: An individual or entity using the RedCap Ticket platform to create, promote, and sell tickets for events.

 

4. Responsibilities of Event Organizers

Event Organizers are responsible for ensuring that their events comply with all applicable laws, regulations, and rules, and for obtaining all necessary licenses and permits required for their events.

 

5. Privacy and Data Handling

The Company is committed to protecting the personal data of Users, and all data handling is conducted in accordance with the Privacy Policy. The Company may provide Event Organizers with certain user information (such as names and contact details) when necessary, and Event Organizers are responsible for safeguarding this information.

 

6. License to Use the Platform

We grant Users and Event Organizers a limited, non-exclusive, non-transferable license to use RedCap Ticket, subject to these Terms.

 

7. Transactional Risks and Dispute Resolution

All transactions and disputes between Users and Event Organizers are the responsibility of the respective parties. The Company is not responsible for intervening in such disputes unless necessary for mediation purposes.

 

8. Disclaimer of Warranties and Limitation of Liability

RedCap Ticket is provided “as is” without any warranties, express or implied. The Company disclaims liability for any indirect or consequential damages arising from the use of the RedCap Ticket platform. The Company is not liable for any losses or disputes arising from the conduct of Users or Event Organizers.

 

9. Event Cancellations, Postponements, and Changes

- Cancellations: If an event is canceled, Users are entitled to a full refund. RedCap will process the refund once the Event Organizer returns the ticket proceeds.

- Postponements: If an event is postponed, Users may choose to retain their tickets for the rescheduled date or request a refund, subject to the Event Organizer’s policy.

- Changes: In the event of changes to the event time, location, or other details, RedCap will notify Users as soon as possible. Responsibility for such changes lies with the Event Organizer.

 

10. Refund Policy

Unless otherwise stated, ticket sales are final and non-refundable. For refunds related to event cancellations or postponements, the Company will process the refund after receiving the proceeds from the Event Organizer. Users are not entitled to refunds for personal reasons (e.g., incorrect purchase, failure to attend).

 

11. Ticket Resale and Waiting List

- Resale: Users are not permitted to resell or transfer tickets for commercial purposes. RedCap may allow ticket resale through a waiting list in certain circumstances.

- Waiting List: When an event is sold out, RedCap may enable a waiting list feature, allowing Users to offer unused tickets for sale. If another User purchases the ticket, the original User will receive a full refund.

 

12. Third-Party Websites and Content

RedCap Ticket may contain links to third-party websites. The Company is not responsible for the content, privacy policies, or practices of these third-party sites.

 

13. Service Fees and Refunds

RedCap charges service fees for ticket processing and platform maintenance. Service fees are non-refundable at the time of ticket purchase.

 

14. Termination and Modification of Terms

The Company reserves the right to terminate access to the RedCap Ticket platform or modify these Terms at any time. Any modifications will be published and communicated to Users in a timely manner.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which the Company is located. Any disputes arising under these Terms will be resolved within this jurisdiction.

 

16. Event Participation Disclaimer

Users agree to voluntarily assume all risks associated with participating in events and release the Company from any liability for injury, loss, or damages incurred during the event.

 

17. Marketing Communications

By purchasing tickets through RedCap, Users consent to receiving marketing communications, including promotional materials via email or SMS. Users can opt-out of receiving such communications by contacting the Company.

 

18. Seat Selection

For certain events, Users may select specific seating areas when purchasing tickets. If seating arrangements change due to unforeseen circumstances, the Company will notify Users in advance and provide comparable seating where possible. The Company will strive to ensure that tickets purchased in the same order are seated together.

 

19. Health and Safety Protocols

All Users must comply with the health and safety protocols established by Event Organizers and venues (e.g., mask mandates, vaccination requirements). The Company is not responsible for Users being denied entry due to non-compliance with such protocols.

 

20. Special Terms for Outdoor Activities

- Risk Acknowledgment: Users acknowledge that outdoor activities involve inherent risks, including injury or death, and voluntarily assume all such risks. RedCap and Event Organizers are not liable for any losses or damages.

- Health Declaration: Users declare that they are in good health and fit to participate in their chosen activities. Any health concerns that may affect participation must be disclosed to the activity provider.

- Emergency Medical Consent: Users authorize Event Organizers to take necessary medical actions in case of an emergency, with the costs borne by the Users.

 

21. Data Encryption and Usage Rights

The Company encrypts all data related to ticket buyers and event organizers on the platform to ensure data security. The Company reserves the right to use such data for marketing purposes, analytics, and service improvements. Users and Event Organizers agree that the Company may anonymize the data for these purposes and send relevant marketing materials via email, SMS, or other channels to Users and Event Organizers.

 

22. User Disputes and Payment Method Recharge

- Compliance with Event Organizer Refund Policies: Users are required to comply with the Event Organizer’s refund policies after purchasing a ticket. If the User has any concerns or refund requests, they must first attempt to resolve the issue directly through the Event Organizer’s provided channels.

- Unauthorized Disputes: If a User initiates an unauthorized dispute with their bank or credit card company that contradicts the Event Organizer’s refund policies, RedCap reserves the right to request that the User withdraw the dispute and handle the matter in accordance with the Event Organizer’s refund policy.

- Malicious Disputes and Recharge: In the case of repeated malicious dispute claims that result in additional costs to the platform or Event Organizer, RedCap reserves the right to recharge the User's stored payment method to cover any costs incurred, including bank fees, legal fees, or other associated expenses. Such recharges will be conducted in accordance with the User's prior consent under the terms of service, ensuring that the platform and Event Organizer are protected from undue losses.
